TERMS OF USE
Welcome to Community Mountain (the "Platform"), operated by Community Mountain, a nonprofit organization based in Lynchburg, Virginia ("we," "us," or "our"). The Platform is a community networking and media hub designed to connect individuals in need with volunteers, organizations, charities, and resources to foster stronger communities through collaboration, education, wellness, and holistic development. This includes features like user profiles, needs postings, service offerings, community media sharing, and initiatives such as educational support programs (e.g., reading and math recovery for students).
These Terms of Use ("Terms") govern your access to and use of the Platform, including our website (communitymountain.com), any mobile applications, and related services (collectively, the "Services"). By accessing, registering for, or using the Platform, you agree to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you are using the Platform on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and "you" refers to both you and the organization.
If you do not agree to these Terms, do not access or use the Platform.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or use the Platform independently. If you are under 18, you may only use the Platform with the involvement and verifiable consent of a parent or legal guardian. For features involving minors (e.g., student educational initiatives), we require parental/guardian consent and involvement where applicable, in line with best practices for children's online privacy. We reserve the right to refuse access or terminate accounts if we believe you do not meet these requirements.
2. Account Registration and Security
To access certain features (e.g., posting needs, offering services, or participating in networking), you must register an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials, all activities under your account, and notifying us immediately of any unauthorized use. You may not create multiple accounts or impersonate others. We may suspend or terminate your account for violations.
3. User Conduct and Prohibited Activities
You agree to use the Platform in a manner consistent with our mission of positive, purpose-driven community building. Prohibited activities include posting harmful, illegal, harassing, defamatory, or discriminatory content; spamming or unauthorized advertising; sharing others' personal information without consent; fraud or malware distribution; interfering with functionality; or any activity violating laws. We may moderate and remove content without notice.
4. User-Generated Content
You retain ownership of content you post. By posting, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute it on the Platform to facilitate community connections. You represent that your content does not infringe third-party rights. We are not responsible for or endorse user-generated content; you use it at your own risk.
5. Community Networking and Interactions
The Platform facilitates voluntary, community-driven connections (e.g., matching needs with volunteers or services, educational partnerships). We do not guarantee matches, outcomes, or user reliability. You are responsible for verifying backgrounds (e.g., for volunteering with vulnerable populations) and any interactions. No employment or contractual relationships are created through us unless explicitly stated.
6. Intellectual Property
The Platform's design, trademarks (e.g., "Community Mountain," "Seven Towers of Community"), and our content are our property or licensed to us. Limited personal, non-commercial use is permitted; no copying or commercial use without permission.
7. Disclaimers and Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES FROM YOUR USE, INCLUDING INTERACTIONS OR INTERRUPTIONS. OUR TOTAL LIABILITY SHALL NOT EXCEED $100. AS A NONPROFIT, WE PROVIDE SERVICES FOR COMMUNITY BENEFIT WITH NO GUARANTEES OF AVAILABILITY OR RESULTS.
8. Indemnification
You agree to indemnify and hold us harmless from claims, losses, or damages arising from your use, violations of these Terms, or infringement of rights.
9. Termination
We may terminate or suspend access at any time. Survival provisions (e.g., disclaimers, indemnification) continue.
10. Changes to Terms
We may update these Terms. Material changes will be notified (e.g., via email or Platform notice). Continued use constitutes acceptance.
11. Governing Law and Dispute Resolution
These Terms are governed by Virginia law, without regard to conflicts of laws. Disputes shall be resolved in courts in Lynchburg, Virginia.
12. Miscellaneous
These Terms are the entire agreement. Invalid provisions do not affect the rest. No waiver is a further waiver.
